Terms of Service

1. Acceptance of terms

By creating an account or using Uneven (the "Service"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age in your country) and able to enter a binding contract. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Your account

• You are responsible for your account and for maintaining the security of your login credentials.
• Provide accurate information and keep it up to date.
• Notify us immediately of any unauthorized use of your account.

4. Your content

• You retain ownership of content you add to the Service (events, notes, attachments, etc.).
• You grant us a worldwide, non‑exclusive, royalty‑free license to host, process, transmit, and display your content as necessary to provide the Service and as you direct (e.g., when you share with others).
• You are responsible for the content you submit and for having the rights to share it.

5. Acceptable use

• Do not misuse the Service, interfere with its normal operation, or try to access it using a method other than the interface and instructions we provide.
• Do not upload unlawful, harmful, or infringing content.
• Do not attempt to reverse engineer or circumvent security features, except to the extent such restrictions are prohibited by law.

6. Plans, billing, and refunds

Some features may require payment (subscriptions or one‑time purchases). Prices, features, and limits are described in the Service and may change from time to time with reasonable notice.

To the extent permitted by law, fees are non‑refundable except where we state otherwise. Nothing in these Terms limits your rights under the Australian Consumer Law and other mandatory consumer protections.

7. Third‑party services

The Service may depend on or link to third‑party products and services (e.g., authentication, hosting, analytics). Their terms and privacy policies govern your use of those services.

8. Beta features

From time to time we may offer experimental or pre‑release features. Beta features are provided "as is" and may change or be discontinued at any time.

9. Intellectual property

• We and our licensors own the Service, including software, design, and trademarks. These are protected by intellectual property laws.
• We welcome feedback and may use it without restriction or compensation.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you materially breach these Terms, create risks for other users, or where required by law. Upon termination, sections intended to survive (e.g., disclaimers, limitations of liability) will remain in effect.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. We do not guarantee the Service will be uninterrupted or error‑free.

12. Limitation of liability

To the maximum extent permitted by law, in no event will Uneven be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) AUD $100.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you have under the Australian Consumer Law or other law that cannot be excluded.

13. Governing law

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts in New South Wales, Australia, for any dispute arising out of or relating to the Service or these Terms.

14. Changes to the Service and these Terms

We may modify or discontinue features with reasonable notice where practicable. We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (e.g., in‑app notice or email). The “Last updated” date shows when these Terms were last changed.
